K’taka Minister’s letter to TN CM: C Ve Shanmugam says TN not ready for talks

Tamil Nadu law minister C. Ve. Shanmugam has dubbed Karnataka Water Resources Minister DK Shivakumar’s move to open dialogue with the lower-riparian state on the Mekedatu reservoir as an attempt to slow down the case filed against the reservoir in the Supreme Court, and the contempt proceedings initiated against him and others last week.

In his letter to Shivakumar on Monday, Shanmugham reiterated Tamil Nadu’s stand that any construction or even preparation of a Detailed Project Report for the construction of a new reservoir, project “is a clear violation” of the February 16, 2018 apex court judgement on the Cauvery dispute involving two states.

“This has reference to your letter dated 6.12.2018 seeking an appointment with the Hon’ble Chief Minister of Tamil Nadu to discuss about the Mekedatu Project of Karnataka.
The Government of Karnataka in violation of the judgment of the Hon’ble Supreme Court dated 16.2.2018 has obtained permission from the Central Water Commission to go ahead for preparation of a Detailed Project Report for the Mekedatu Project, without informing and getting the
concurrence of Tamil Nadu and of other co-basin States and without any information to the CWMA, which is an authority established for the implementation of the decision of the Tribunal as modified by the Hon’ble Supreme Court,” he said.

“The request of the Government of Karnataka to discuss about the Mekedatu Project with the Government of Tamil Nadu, is an attempt to impede the proceedings pending on the Application filed on 30.11.2018 by Tamil Nadu and also the Contempt Proceedings initiated against you and
others in the Hon’ble Supreme Court on 5.12.2018 and the matter has now become sub-judice,” he added.

“I, therefore, request you not to proceed in any manner with the preparation of a Detailed Project Report for Mekedatu Project of Karnataka and not to take up any construction activities in any place in the Cauvery
Basin of Karnataka, without the prior consent of the Government of Tamil Nadu. Any construction or even preparation of a Detailed Project Report for construction of any new reservoir/project is a clear violation of
the judgment of the Hon’ble Supreme Court dated 16.2.2018.”

“Hence, I request you to desist from preparation of a Detailed Project Report for Mekedatu project.
I also request the Government of Karnataka to comply with the judgment of the Hon’ble Supreme Court dt.16.2.2018 in letter and spirit,” he concluded
